Terms and conditions of sale
Apply to any sale of wood pellets concluded with Pierre Sehailia, by phone, by email or through this site. They do not cover the rental of a storage unit, which is the subject of a separate document, published when the units open.
These pages are a complete draft, written from the applicable Belgian legal framework, but not yet reviewed by the company's lawyer. Every point still needing validation is flagged exactly where it arises. None of these pages should remain as is after review, and their final version must be online before the first sale.
1. Purpose
These terms govern the sale of wood pellets, by the bag, the pallet or the full truckload, to businesses and, where applicable, to private individuals.
2. Price and VAT
Prices are shown excluding VAT between businesses, and inclusive of all taxes for a private customer. The VAT rate applicable to pellets is 6%, under heading VII, 12° of table A of Royal Decree No. 20 of 20 July 1970, confirmed by customs classification codes CN 4401.31, 4401.32 and 4401.39. The final price appears on the quote or order confirmation.
3. Order
An order becomes firm on receipt of a written confirmation, by email or by a signed quote. The quantity, format and requested date must be set before confirmation.
4. Delivery and collection
Delivery across Wallonia and northern France, within the area stated on the site. On-site collection is possible on a booked slot. The indicative lead time appears on the quote; we let you know if there is a delay.
5. Payment
Payment terms, whether prepayment or payment on delivery, are specified on each quote. Any late payment between businesses automatically triggers the interest and the fixed compensation set out by the Act of 2 August 2002 on late payment in commercial transactions.
6. Invoicing
For a Belgian business customer, the invoice is issued in the structured electronic Peppol format, mandatory since 1 January 2026. A standard invoice remains valid for a private customer or a customer based outside Belgium.
7. Right of withdrawal
For a distance order placed by a private individual, a fourteen day withdrawal period applies in principle (article VI.47 of the Belgian Code of Economic Law). to be validated by a lawyer before publication: the exact wording of the exceptions that apply when the price follows a market fluctuation (article VI.53 CEL), and the standard withdrawal form to be published on this page.
8. Compliance and complaints
Every lot comes with its analysis report. A complaint about a lot received must be reported with its lot number, visible on the delivery note, as soon as possible.
9. Liability
to be validated by a lawyer before publication: the limitation of liability clause must remain compliant with articles VI.82 to VI.87 of the Belgian Code of Economic Law on unfair terms, which notably prohibit any total exemption in the event of proven fault.
